Eligible Entrants:
Entry is only open to NSW, NT, QLD, TAS, VIC and WA residents who are 18 years and over.
How to Enter:
To enter the Promotion, the entrant must visit rabbitohs.ac-page.com/aqualandcompetition, follow the prompts to the Promotion entry page; and fully complete and submit the online entry form with their personal details (first name, last name, email address, mobile number and state/territory of residence) during the Promotional Period.
Entries Permitted:
There is a limit of one (1) entry permitted per person.
Any entries (above limit specified above) from the same person/email/phone number and fraudulent entries will be disqualified.
Draw:
The draw will take place at Hive Marketing Group, Suite 222, 117 Old Pittwater Rd, Brookvale NSW 2101 on 24/04/24 at 12pm AEST using computerised random selection.
The draw conductor may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
Winner Determination/Qualifying Activity Details:
A. The first three (3) valid entries drawn (“Finalists”) will be required to participate in a Qualifying Activity in order to determine which entrant will take part in the contingency game (“the Game”) for the chance to win the AURA by Aqualand Apartment valued at up to $1,500,000 AUD ("Major Prize"). The one (1) Finalist to successfully ’win’ against the other two (2) Finalists, based on the result of the Qualifying Activity will have the opportunity to take part in the Game (“the Player”).
B. The Qualifying Activity will take place during half time at the South Sydney Rabbitohs vs Penrith Panthers match at 7.50pm on Thursday 2nd May 2024 at Accor Stadium (“Eligible Match”). Details and rules of the Qualifying Activity, including requirements to ‘win’, will be communicated to Finalists prior to the start of the activity. The two (2) Finalists who do not proceed to play in the Game will each be awarded the consolation prize of one (1) Etymon dining voucher valued at $250 AUD each.
C. The three (3) Finalists will each be provided with two (2) tickets to the Eligible Match (if they do not already have a ticket) (with each ticket valued at $25). All costs associated with travel to and from the Eligible Match (including any applicable flights, accommodation, etc.) will be the responsibility of the Finalists and their guest.
D. Any and all costs associated with attending the Game are the sole responsibility of the Participant. Finalists unable or unwilling to attend the Eligible Match will forfeit their ability to participate in the Qualifying Activity and the Game.
E. Under no circumstances whatsoever will a proxy or replacement participant be permitted to take part in the Qualifying Activity or the Game, if the Finalist is unable to participate for any reason. An ID check may be carried out by the Promotional Staff prior to the Qualifying Activity and Game starting to ensure the Finalist is the correct eligible Qualifying Activity or Game participant.
Game Details:
A. Directly after the Qualifying Activity is completed, the Player will be invited to stand in front of an ‘Aqualand’ front door on the field at the Eligible Match. The free-standing door will be set up on the field of play.
B. The Player will be asked to pick a number from 1 to 100. Each number will correspond to a pre-sealed envelope and will contain a key. Once the Player specifies a number to the Promoter’s representatives, they will not be able to change their selection. If there is any dispute to the number selected by the Player, the Promoter’s decision will be final.
C. One envelope will contain the correct key that will open a lock on the ‘Aqualand’ front door and the other 99 envelopes will contain incorrect keys that will not open the lock on the door.
D. If the key within the envelope chosen by the Player opens the lock on the door, they will be awarded the Major Prize of the AURA by Aqualand apartment valued up to $1,500,000 AUD. If the key within the envelope chosen by the Player does not open the lock on the door, the Major Prize will not be awarded, and the Player will instead be awarded the consolation prize of AU$5,000 cash (paid via bank transfer to the Player).
E. A minimum of two Go-Pros and/or hand-held Mobile Phones will be set up to take footage of the Qualifying Activity/Game, or preferably live coverage footage (Channel 9 or similar) and this will be supplied by Rabbitohs to an independent scrutineer, before a prize will be finally awarded.
F. A Loss Adjustor must be present at the Game to ensure the Game is conducted as per these Conditions of Entry and any Game rules.
G. The consolation prize, if awarded, will be delivered via bank transfer to an Australian bank account in the Player’s name within 30 business days of the Game. The Player will be required to provide their Australian bank details to the Promoter in order for the Promoter to facilitate the award of the prize. If the Player fails to provide their bank account details by the date/time specified by the Promoter, they will forfeit their right to the prize.
H. The details of the Qualifying Activity including any applicable conditions will be determined by the Promoter and provided to the Finalists prior to the start of the Qualifying Activity. The Finalists will be provided with an eligibility form explaining the rules of the Qualifying Activity which they must sign indicating their understanding and agreement to the rules, prior to participating in the Qualifying Activity.
I. The Qualifying Activity/Game will be recorded and will be reviewed by an independent scrutineer, and a prize will only be awarded when/if there is no reasonable doubt the Qualifying Activity/Game was played fairly in accordance with the applicable rules, with no tampering by the Finalist/Player.
J. The Player’s odds of winning the Major Prize, are 1 in 100. The odds of being drawn as a Finalist may be significantly higher than the odds of the Player winning the major prize, and will depend upon the number of entries received.

Prize Conditions:
AURA by Aqualand Apartment:
• The AURA by Aqualand Apartment means Apartment 205 in the development known as “AURA” at 168 Walker Street, North Sydney, NSW, 2060 currently being developed by AQUALAND NORTH SYDNEY DEVELOPMENT PTY LTD - ABN 60 603 278 379. AURA Apartment 205 is an off the plan apartment valued at up to $1,500,000 AUD.
• Aqualand reserves the right to change the apartment number on the condition the revised apartment is valued at the same price and is equivalent to a one (1) bedroom AURA by Aqualand apartment with no car park. Aqualand will be responsible for any applicable statutory fees or charges in order to transfer the AURA by Aqualand apartment to the Major Prize winner. Any other costs associated with the apartment, e.g. land tax, water/council rate, strata fees, insurance, furniture and fit out, electricity costs, conveyancing costs, legal fees and financing costs etc, will be the responsibility of the Major Prize winner.
• The Major Prize winner must consent to and sign any documents necessary in order to effect the transfer of the AURA by Aqualand Apartment to the Major Prize winner.
• The AURA by Aqualand residential development is currently under construction, and the construction completion date is scheduled for 2024. The AURA by Aqualand Apartment 205 which is the major prize is being built off the plan and the settlement date will be confirmed with the prize winner closer to the time of settlement. The Major Prize winner may not nominate any other third party to acquire the Aqualand Apartment in its place.
$250 Etymon Dining Voucher:
• Any ancillary costs associated with redeeming the voucher are not included. Any unused balance of the voucher will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
Tickets:
• The Eligible Match ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restrictions. The Promoter and event organisers hereby expressly reserve the right to eject any winner and/or his/her companion for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
Winner Notification:
The Finalists will be notified by email and phone on the same day as the draw (24/04/24).
The Finalists' details will be published at http://www.rabbitohs.com.au/competitions/ on 24/04/24.
Unclaimed Prizes:
If a Finalist cannot be contacted or does not confirm their participation by 2pm AEST 26/04/24, the Promoter will contact the next reserve finalist. This process will continue with each entrant having 2 hours (120 minutes) to call the Promoter back and accept participation in the Qualifying Activity and Game from the first phone call to them by the Promoter. If a Finalist fails to do so they will forfeit their right to participate in the Qualifying Activity and Game and therefore their opportunity to win a prize.
If there are no reserve eligible entrants drawn in remaining, there will be a redraw on 27/04/24 at 12:00 pm AEST at Hive Marketing Group, Suite 222, 117 Old Pittwater Rd, Brookvale NSW 2101. The winners of the redraw will be notified by email and phone on the same day as the redraw. The new Finalists’ details will be published at http://www.rabbitohs.com.au/competitions/ on 27/04/24.
If there are no Finalist/s or Finalist/s for this Promotion cannot be found, this information will be published on http://www.rabbitohs.com.au/competitions/.

The entrant agrees and acknowledges that they have read these Conditions of Entry (and Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.

The Promotion commences on the Start Date and ends on the End Date ("Promotional Period"). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.

Valid and eligible entries will be accepted during the Promotional Period.

Employees (and their immediate family members) of agencies/companies directly associated with the conduct of this Promotion, the Promoter, businesses involved in determination of winner/s for the Promotion, businesses involved in the management of the Promotion, any organisation benefiting from the Promotion, the Promoter’s distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

All reasonable attempts will be made to contact each winner.

If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize within a reasonable time, as specified by the Promoter, or is unavailable at the designated time for the Event, they forfeit the prize and the Promoter is not obliged to substitute the prize.

The value of the prizes is accurate and based upon the recommended retail value of the prizes (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prizes after that date.

No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter.

If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and specification, subject to any written directions of a regulatory authority.

No entry fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website of entry via their Internet service provider.

If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.

Entrants' personal information will be collected by the Promoter. Personal information will be stored on the Promoter's database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter will handle personal information in accordance with its privacy policy which is located at www.rabbitohs.com.au/privacy-policy (for the Promoter) and https://www.aqualand.com.au/privacy-policy/ (for Aqualand). The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion.

For the purposes of public statements and advertisements, the Promoter may only publish the winner's surname, initial and State/Territory or postcode of residence.

The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of a prize, if the Promoter determines in their absolute discretion, that a winner is not in the physical or mental condition necessary to be able to safely participate in or accept the prize. It is a condition of accepting the prize that a winner may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize.

If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry in the event of any inconsistency. To the extent permitted by law the Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.

Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.

The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.

The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final.

The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation). For the sake of clarity, this clause shall not apply where the Promoter has contributed to or caused such loss, expense, damage, personal injury or death and shall not apply to any liability which cannot be excluded by law (in each case the Promoter’s liability is limited to the minimum allowable by law).

The winner(s) will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.

Unless otherwise specified, a prize is a single event for the winner (and where relevant their guests) and cannot be separated into separate events or components.

The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.

Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
